DiPasquale Moore, LLC (“DM Law”) is proud to announce that the Missouri Court of Appeals recently affirmed a multi-million-dollar judgment that we obtained for our client, who was catastrophically injured in a 2017 car crash. After the crash, the insurance company for the at-fault driver of the other car attempted to avoid responsibility by denying the claim, claiming that they had cancelled the policy prior to the crash (based on the policy holder’s alleged misrepresentation as to the ownership, location and operators of the vehicle), even though the policy was in place at the time of the crash and did cover the accident.
Determined to get justice for our client, DM Law took the case to arbitration, through which it secured an award from the arbitrator and ultimately a judgment in the Circuit Court of Jackson County, Missouri for $4 million. But that was just the beginning – because the insurance company took the position that the policy did not cover this claim, in order to enforce the judgment, DM Law had to bring the insurance company to Court through a garnishment proceeding. In March 2021, DM Law prevailed in the garnishment proceeding, where the trial court ruled that the insurance company “improperly denied coverage” to our client. The insurance company then appealed that decision. On May 31, 2022, after extensive legal briefing and argument, the Missouri Court of Appeals, Western District, upheld the trial court’s decision, deciding that there was coverage for this claim as the policyholder did not misrepresent the ownership, location or operator of the vehicle.
This is a huge win for our client. No matter how many times the insurance company tries to deny responsibility, we will continue to fight for our client and remain committed to securing for him the justice that he deserves.
