Our client, a schoolteacher, was struck head-on by a tree-trimming truck that crossed into her lane. This collision caused her to spend 4 days in KU Medical Center, where she was treated for a concussion, broken facial bones, and the loss of her left eye.
Due to the severity of the injuries, we were able to get $500,000 from the tree-trimming company and an additional $50,000 from the truck driver’s coverage, for a total of $550,000 in settlement.
However, our work was not over yet. Our client’s health insurance came from her employer. The insurance company claimed that they were to be reimbursed for the total settlement since they were covering the injured victim.
We would not let our client lose her compensation. We were able to demonstrate through Kansas law that they had no claim over our client’s settlement, and that she would keep the remaining compensation after paying for the medical bills.
